1. Acceptance of Terms

By accessing or using AIFunLab.io ("Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site.

2. Who Can Use This Site?

This Site is intended for use by adults (parents, caregivers, or educators) to engage in AI activities with children. We do not knowingly permit children under 13 to create accounts, submit personal information, or interact independently with the Site.

  • Children Under 13: Children under 13 may only use this Site under the direct supervision of a parent or legal guardian. We do not knowingly collect personal data directly from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA). Any data involving a child (e.g., age) must be submitted by a parent or guardian, and only with their full consent.
  • Teens (13+): Teens may browse the Site with parental permission. We do not offer services directed at minors directly.

3. User Submissions & License

  • Your Grant: By submitting content (e.g., projects, photos), you grant AIFunLab a non-exclusive, royalty-free, worldwide license to use, modify, and share it (with credit, e.g., "By @ParentName") on our Site, social media, or promotional materials. You confirm you own or have rights to the content.
  • Ownership: You retain ownership of your content.
  • Rules: Content must be kid-friendly, original, educational, and free of personal data, spam, or hate speech. "Kid-friendly" means content appropriate for children, free from inappropriate material such as nudity or explicit language, and suitable for educational purposes. We may reject non-compliant submissions.

4. Affiliate Partnerships & FTC Compliance

  • Disclosures: Affiliate links to apps, camps, or tools will be clearly disclosed within the content.
  • No Endorsement: We recommend tools we believe in, but outcomes are not guaranteed. Research third-party services before use.
  • Commissions: We may earn fees from qualifying purchases.

5. Intellectual Property

  • Our Content: Blogs, guides, and AI-generated art and images are owned by AIFunLab. Share only with a link back to our Site.
  • Third-Party Assets: Licensed assets (e.g., iStock images) may not be redistributed.
  • Your Content: You retain ownership but grant us rights as per Section 3.

6. Disclaimers & Liability

  • Educational Purpose: Content reflects opinions and experiences for educational use. Parents must supervise children closely.
  • No Liability: AIFunLab is not responsible for outcomes of projects or third-party tools, AI chatbot interactions (parents must monitor), errors in tutorials or external links, or any harm or loss from Site use.
  • Third-Party Services: We are not liable for linked apps, camps, or tools.
  • Limitation of Liability: To the maximum extent permitted by applicable law, the total aggregate liability of the Site operator (Yu Tsen Cheng) for any claims, damages, or losses arising out of or related to your use of the Site shall be strictly limited to the greater of: (a) the total amount paid by you to the Site for services during the past six months, or (b) fifty dollars ($50 USD). You agree that this limitation represents a fair and reasonable allocation of risk given the free educational nature of the content provided.

7. Privacy Policy

8. Security

We take the security of your personal information seriously. Your data is stored and processed by MailerLite, which employs industry-standard security measures including encryption, anti-virus software, and two-factor authentication. While we strive to protect your data, no method of transmission over the internet or electronic storage is 100% secure. In the event of a security breach we will notify affected users as required by law, but we are not responsible for any damages resulting from such breaches.

9. Children's Privacy & Parental Responsibility

AIFunLab is designed for adults guiding children in educational AI activities. Children should not submit personal information or use the Site independently. Parents or legal guardians are solely responsible for supervising their child's use of the Site and for deciding whether the content is appropriate. If we learn that a child under 13 has submitted personal information without verifiable parental consent we will delete it promptly.

10. Termination

We may block users or remove content for spam, abuse, harmful behavior, or violating these terms, at our discretion.

11. Future Sales & Refunds

Future digital or physical products will have separate terms provided at purchase. Refunds follow the policies of the respective products or services.

12. Governing Law

These terms are governed by California state law. Disputes fall under California jurisdiction.

13. Operator & Company Status

AIFunLab is currently operated by an individual and not a registered company. The Site is owned and managed by Yu Tsen Cheng, doing business as AIFunLab. We will update these Terms and our Privacy Policy when the business becomes formally incorporated.

14. Modifications to Terms

We may update these Terms of Use to reflect changes to our services, new features or products, or for operational, legal, or regulatory reasons. When we update these Terms we will post the updated version on our website. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
